Use of Golf Carts Within the Settlement
One of the conditions in the Texas Transportation Code defining where golf carts can be legally driven states that they are permitted on streets within “Master Planned Communities”. However, this term is not defined in any of the Texas statutes and previous guidance was that the Settlement did not qualify under this classification. However, a legal opinion signed by Greg Abbott has come to our attention which changes this conclusion.
As explained in detail in the revision on our website posting on this subject, exprapolation from a decision by the Supreme Court of Texas allows the interpretation of the term "Master Planned Community" to include subdivisions such as the Settlement. Hence, contrary to the earlier guidance, properly equipped and driven golf carts CAN be legally driven on Settlement streets.
