Harris County Implements New Fire Code Requiring Backup Power in Nursing Homes and Assisted Living Facilities

Harris County Commissioners Court recently approved a groundbreaking amendment to its fire code, requiring all nursing homes and assisted living facilities in unincorporated areas to install backup power systems for heating, ventilation, and air conditioning (HVAC). The initiative addresses risks posed to vulnerable populations during emergencies, such as extreme weather events and power outages.

The regulation, which took effect on January 1, mandates compliance by the end of 2025 for approximately 120 senior care facilities. It aims to maintain safe temperatures, power critical medical devices, and enable emergency communications during outages. Texas, which has the nation’s third-largest senior population, currently lacks statewide mandates for HVAC backup power in these facilities.

Commissioner Lesley Briones, representing Harris County Precinct 4, emphasized the critical need for the measure. “In February 2021, Winter Storm Uri left 10% of Texas nursing homes and nearly a third of assisted living facilities without power. Over 100 seniors lost their lives. That’s unacceptable,” she stated. “Harris County is stepping up to protect our seniors and lead the way for the rest of Texas.”

A Life-Saving Measure

Harris County Fire Marshal Laurie Christensen, a key proponent of the amendment, highlighted its importance during the press conference. “This isn’t just about enforcement—it’s about education and prevention,” Christensen said. “These backup systems will save lives by ensuring facilities can maintain safe temperatures, power medical devices, and support emergency evacuations.”

Christensen noted that Harris County is the first in Texas to adopt such a regulation. “We understand the financial challenges for smaller facilities,” she added. “That’s why we’re committed to working with operators to develop action plans and ensure compliance.”

A National Problem with Local Solutions

Greg Shelly, senior program manager at the Harris County Long-Term Care Ombudsman Program, praised the county’s leadership. “This is a critical step forward,” Shelly said. “Nationally, only 29% of assisted living facilities have backup power capable of running HVAC systems. Harris County is setting a precedent that others should follow.”

Shelly also encouraged facilities to explore funding options, such as the Texas Backup Power Package, to offset the cost of compliance. “These systems aren’t just about safety—they’re a competitive advantage for facilities looking to attract residents,” he noted.

Looking Ahead

As extreme weather events become more frequent, Harris County’s proactive approach could serve as a model for other jurisdictions. Briones called on state and federal lawmakers to take similar action. “We hope this inspires counties across Texas and the nation to enhance protections for their seniors,” she said.

The fire marshal’s office will oversee implementation, conducting inspections as part of its existing annual reviews. In the meantime, Harris County officials are collaborating with stakeholders to ensure facilities are equipped with the necessary resources and support.

“Protecting our seniors is a shared responsibility,” Briones concluded. “Together, we’re building a safer, stronger community for everyone.”
