DID YOU KNOW?
• Please note we are entering holiday seasons. Neighbors will have parties and fireworks. We ask that neighbors hosting parties be kind and courteous to surrounding houses. We also ask that surrounding houses be kind and courteous of the holiday season. Please be neighborly to one another.
• We live in Harris county and there is no noise ordinance. Harris County Sheriff’s Office deputies follow the Texas Penal Code, section 42.01, section (a) 5, Disorderly Conduct. “A person commits an offense if he intentionally or knowingly: (5) makes unreasonable noise in a public place other than a sport shooting range, as defined by Section 250.001, Local Government Code or in or near a private residence that he has no right to occupy…”
• If the noise is “unreasonable” in the opinion of the responding peace officer, a citation may be issued.
• Try writing a letter to your neighbor, stating to the neighbor when the noise/barking is occurring and how it is affecting your sleep
• Bring this topic up to your HOA Board, providing the address and noted times of offenses.
• If you have to resort to calling law enforcement, make sure and document all calls made, to include the date and time and the officers name and a call slip number as well. Document the barking, by recording it on your phone and note the time and date it is occurring. This is all evidence if you need to file a civil suit against the owner in justice court (aka, small claims court). There are legal remedies and homeowners do not want to be sued, as it impacts their homeowners insurance rates.
